Information you submit through our web forms, online chat, or text messages is a request for HopeGuard to contact you — it is not a binding agreement for services and does not guarantee availability, pricing, or scheduling. Any actual restoration or related services we perform are governed by a separate written estimate, work authorization, or service agreement signed by you and HopeGuard, which will control in the event of any conflict with this Site or these Terms.

Message and data rates may apply, and message frequency varies. Reply STOP to cancel at any time, or HELP for assistance. TO THE FULLEST EXTENT PERMITTED BY LAW, HOPEGUARD AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY ARISING FROM OR RELATED TO THE SITE WILL NOT EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID TO HOPEGUARD FOR SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. This limitation does not apply where prohibited by law, and does not limit liability arising from a signed service agreement, which is governed by its own terms.
11. Indemnification
You agree to indemnify, defend, and hold harmless HopeGuard and its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your violation of these Terms or your misuse of the Site.
12. Governing Law; Venue
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in New Castle County, Delaware, and you consent to personal jurisdiction there.

We may revise these Terms at any time by updating this page. The “Last Updated” date above reflects the most recent revision. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
14. Severability
